‘Kim K. vs. The Gap’ lawsuit gets personal

Last summer, Old Navy spewed out a series of painfully annoying commercials, including one memorable ad featuring a singing and dancing Kim Kardashian lookalike.

According to Kim Kardashian, the retailer’s biggest offense was not the horribly catchy jingle, but the ads’ use of her likeness without her authorization. They created confusion in the marketplace, she is arguing, because consumers didn’t know whether or not the commercial featured Kim herself. (RELATED: Full coverage of Kim Kardashian)

Kim filed suit for $20 million in damages against the retailer for choosing singer-dancer-actress Melissa Molinaro for the commercial.

Old Navy’s parent company, The Gap, is rounding out a hefty defense against Kardashian that includes a high-powered lawyer and a list of personal attacks against the reality starlet.

The Gap’s main defense? It isn’t possible to ruin the reality starlet’s reputation, since it is ruined already.

The defense team is seeking paperwork which aims to trounce on Kim’s image. First, they want to know why her clothing deal with retailer Bebe fell through, and about her record as a singer and a dancer. The Hollywood Reporter wrote:

The moves could be in anticipation of making an argument similar to those in defamation cases where a defendant asserts the plaintiff is “libel-proof,” with a reputation so stained that no injury could cause true damage.

Gap’s lawyers may also call Kim’s former boyfriend, Miami Dolphins running back Reggie Bush, as a witness. Bush reportedly started dating Molinaro after she appeared in the Old Navy commercial.

It looks like Molinaro may have four-upped the Kardashian bombshell, whose talents the world isn’t quite certain of. Molinaro can sing, act and dance — and now she may even have Kim’s boyfriend.
