Kim Kardashian’s unborn child is (technically) not Kanye West’s baby

Kim Kardashian’s baby isn’t even born yet and it already has to deal with its mother’s insanity.

Kardashian’s unborn child is technically not Kanye West’s baby — at least not under California law.

Since Kardashian is still legally married to her estranged husband, Brooklyn Nets player Kris Humphries, the child is legally “presumed” to be his if the two are still married when she gives birth.

Despite being separated from each other for more than a year, the technicality means that if Humphries wanted to be a real jerk about the whole thing, he could lay claim to the child. Kardashian would have to provide DNA evidence that the kid is in fact half West and not half Humphries.

With the way the divorce proceedings are going, Kardashian could very well still be married to Humphries when she gives birth in early summer.

The reality star filed court papers last week asking to shut the whole marriage down quickly “for not only my health and welfare but also for the health and well-being of my unborn child,” People reports.

Humphries, on the other hand, filed papers saying he doesn’t really care that Kardashian had an “apparently unplanned pregnancy” and argues that it is no reason to expedite the divorce.

His lawyer writes, “[W]hat is really going on here is that an ‘urgency’ in the form of an apparently unplanned pregnancy” is “an opportunity [for Kardashian] to gain a litigation advantage (to) prematurely set this matter for trial.”

Humphries is requesting an annulment from Kardashian and calls the marriage a “fraud.” But Kardashian doesn’t want to have to shell out millions of dollars and is requesting a divorce.

There will be a preliminary hearing on Feb. 15 to determine a court date for the divorce proceedings.
