The House Committee on Ways and Means voted Wednesday to refer ex-IRS official Lois Lerner to the Department of Justice (DOJ) for criminal prosecution.

The closed-door vote comes a day before the House Committee on Oversight and Government Reform is expected to vote to hold Lerner in contempt of Congress for stonewalling its investigation of the IRS scandal.

Lerner previously sat for a “Q+A” with DOJ lawyers that was not under oath and did not hear anything back from the agency. The DOJ’s investigation is headed by Obama political donor Barbara Bosserman.
