After a Wal-Mart truck struck the limousine van carrying Tracy Morgan and his friends, which left Morgan hospitalized and comedian James McNair dead, Morgan’s lawyer is now saying his professional career could be over, Page Six reports.

The 45-year-old sustained a brain injury from the wreck, when he also broke his leg and a few ribs. Morgan has been in physical therapy and undergoing rehab for his speech and cognitive and vocational skills. (RELATED: Tracy Morgan Still Struggling)

When asked if he will return to his career, Morgan’s lawyer Benedict Morelli said “the jury is still out.”

“The doctors don’t know the answer. I don’t know the answer,” Morelli said.

Morgan sued the company for negligence, and in court on Monday, Wal-Mart blamed Morgan for not wearing his seat belt, and said the comedian could have prevented his injuries. (RELATED: Wal-Mart Places Responsibility On Morgan)

The driver, Kevin Roper, had been going 65 mph in a 45 mph zone when he hit the van. Roper had been reportedly awake for over 24 hours.
