A same-sex couple in Kentucky was denied a marriage license for the third time.

Same-sex couple James Yates and William Smith Jr. went to Rowan County Courthouse to get a marriage license Thursday, but were turned down. The county clerk has cited religious reasons for the decisions.

To simultaneously hem against legal action and issuing gay marriage licenses, the courthouse has stopped giving out licenses altogether,  The Courier-Journal reports.

“We should be celebrating right now, enjoying our lives together and enjoying the fact that we could spend our lives together and have it recognized by our country,” Smith told The Courier Journal. “Now we are just kind of on nerves.”

U.S. District Court Judge David Bunning ruled a preliminary injunction against Rowan County Clerk Kim Davis, but Davis is still refusing while awaiting appeal, saying they still have until the end of the month to refuse. The couple plans to come back then to try again.

The Supreme Court recognized same-sex marriage in a 5-4 June ruling. The ACLU is suing on behalf of four couples who have been denied marriage licenses, two of them straight and two of them same-sex.

The couple appeared at the courthouse with a group of people, some of whom recorded the incident. In the video, the couple briefly argues with an employee about the judge’s ruling.
