A judge in Chicago is scheduled to hold a hearing Friday for a lawsuit seeking to block Sen. [crscore]Ted Cruz[/crscore] from appearing on election ballots in Chicago, KSDK TV-5 St. Louis reports.

The man behind the lawsuit, filed with the Cook County Circuit Court, is attorney Lawrence Joyce. He previously raised the issue with the Illinois Board of Elections, which ruled earlier this month that Cruz is a natural-born citizen, and thus constitutionally eligible to serve as president.

Joyce then filed the circuit court appeal, the Chicago Tribune reports.

“What I fear is that Ted Cruz becomes the nominee, come September, Congressman Alan Grayson of Florida will go forward with his threats and probably several other Democrats will file suit to prevent Ted Cruz from being on the ballot,” Joyce told USA Today.

Joyce, a self-proclaimed Ben Carson supporter, fears Democrats pulling the rug out from under the GOP if Cruz wins the nomination.

“What Democrats will do,” if Cruz is nominated “is cherry pick which county courthouse they are going to show up in order to file these petitions.” Illinois Board Of Elections: Cruz Is A ‘Natural Born Citizen’

“I fear they’ll get a string of victories in the lower courts and the funding for Ted Cruz would dry up, his numbers would plummet in the polls, he may be forced to give up the nomination.”

“I tried to talk myself out of it and was unable to do so. It’s plain as day that Ted Cruz is not a natural born citizen of the United States,” he added.
