Whole Foods Market has issued a very strong response to a lawsuit alleging an employee decorated a cake with an anti-gay slur, saying it has proof the claim is a hoax and that it will file a counter-suit.
Pastor Jordan Brown of Austin, Texas filed a lawsuit against Whole Foods Monday, saying he ordered a cake decorated with “LOVE WINS” written in frosting. When he received the cake, it instead read “LOVE WINS FAG” on it.
Brown, who is gay, says he then took the cake home and made a video about the incident without ever opening the dessert box. He said Whole Foods ignored his accusations
Brown held a press conference Monday announcing he filed a lawsuit seeking unspecified damages from Whole Foods for the embarrassment and emotional anguish he allegedly suffered.
But Brown may have bitten off more than he could chew. Whole Foods released security camera footage on Tuesday afternoon that it claims totally undercuts Brown’s narrative, according to the Austin American-Statesman.
“After a deeper investigation of Mr. Brown’s claim, we believe his accusations are fraudulent and we intend to take legal action against both Mr. Brown and his attorney,” the company said in the statement.

The video shows a cashier at the store scanning the top of Brown’s cake as he checks out of the store (Brown is in the bottom right of the footage). This proves the cake’s UPC tag was originally on top of the box, Whole Foods said. That means a great deal, because in Brown’s own video the UPC tag is along the side and bottom of the cake box, suggesting it was tampered with.
Whole Foods also noted that the employee Brown accused of wrongdoing was a member of “the LGBT community.”
Brown and his attorney have not yet responded to Whole Foods’ counter-claim.
If Brown did indeed commit a hoax, it would hardly be the first supposed anti-gay stunt to be exposed as a fraud. Other examples include waitress Dayna Morales, who attempted to raise money online using a fake anti-gay receipt. And Haakon Gisvold, who concocted a bogus story of being beaten up and kicked out of a college fraternity in North Dakota for being gay.
