Stripper Sues Strip Club, Claims She’s More Than Just ‘Independent Contractor’

A San Francisco-based stripper has filed a lawsuit claiming the strip club where she works misrepresents her employment status by stating she is an independent contractor, according to reports Monday.

The Hustler Club is a chain of strip clubs owned by porn industry businessman Larry Flynt. Stripper Angelynn Hermes claimed in her lawsuit the strip club has too much control over her employment to be considered an independent contractor, reports TMZ. Independent contractors tend to have more flexibility but lack many benefits traditional employees get.

Hermes claims in her lawsuit the club tells her what to wear, what to charge and dictates her hours. Independent contractors are supposed to have control over their conditions of employment because they do business with a company, as opposed to an employee who works for a company.

Some businesses misrepresent their workers to avoid funding benefits like health coverage. Hermes notes she doesn’t even get paid an hourly rate because of her employment status and only takes home what she makes in tips. A Hustler Club in Manhattan was also sued in February 2015 for allegedly misrepresenting workers, reports the New York Post.

Still there have been cases where workers claim employment status despite having control over their conditions of employment. Sharing-economy ventures like Uber allow their drivers to dictate working conditions like hours, but are still the target of lawsuits alleging employment misrepresentation.

The Hustler Club did not respond to a request for comment by The Daily Caller News Foundation.
