A school board in Virginia paused implementation of a policy that would allow transgender students to use the bathroom according to their “gender identity.”

The Fairfax County School Board said that it would put a stop to carrying out a policy that would let transgender students use the bathroom and locker room of their choice, reports The Global Dispatch. The school board also canceled a session that planned to discuss and explain the policy in general.

“The Fairfax County School Board directed staff to temporarily suspend implementation of the proposed regulation regarding gender non-conforming and transgender students,” a statement on its website reads.

The school board referred to recent court cases dealing with the transgender bathroom issue as its reason for stepping back the policy.

“The Board determined it needs additional time to evaluate the legal issues surrounding the regulation, including a case now pending before the Supreme Court on this topic from a Virginia school district,” the website reads.

The case in question refers to Gavin Grim, a transgender teen from Virginia, who is currently suing the Gloucester School County Board. Her case is now pending before the Supreme Court. (RELATED: Transgender Bathroom Case Heading For Supreme Court)

School Board Chair Sandy Evans said in a statement the school board will continue to accommodate transgender students and their needs. Evans defended the school’s decision by saying the school works to create a “welcoming environment” for all students.

“FCPS continues to accommodate the needs of all transgender and gender nonconforming students on a case-by-case basis.Meanwhile, we continue to work to create a welcoming and caring environment for all of our students, including transgender and gender nonconforming students,” she wrote.
