A Donald Trump supporter was arrested in Texas for refusing to remove clothing items expressing support for the Republican nominee at a polling place.

Brett Bartlett Mauthe wore a Trump “Make America Great Again” hat and a “basket of deplorables” shirt to a polling place in Comal County, Texas. He complied when asked to remove the hat, but refused to turn his shirt inside out, which led to his arrest for electioneering and loitering near a polling place.

The law Mauthe specifically violated was Section 61.003. of Texas Election Code, which forbids electioneering, defined as “the posting, use, or distribution of political signs or literature.”

Cynthia Jaqua, elections coordinator for Comal County reportedly said, “It’s in the election code. Electioneering is prohibited within a 100-foot marker. You cannot express views for or against a candidate or political party by wearing buttons, T-shirts, hats, whatever else or carrying signs.”

Some in the GOP allege unequal enforcement of the law, like Robert Stovall, Chairman of the GOP in Bexar County, Texas. Bexar told the San Antonio-Express News that he saw the rule being applied selectively to voters wearing pro-Trump shirts but not voters wearing pro-Clinton shirts.
