The Iraqi refugee who raped a boy at a swimming pool in Austria during a “sexual emergency” had his sentence increased from six to seven years by the country’s Supreme Court.

The 20-year-old perpetrator, identified only as Amir A., had his sentence overturned in October after winning the right to appeal. The regional court failed to acknowledge if the boy objected to the assault, which the Supreme Court argued was enough to take up the case.

The Supreme Court found Amir A. guilty of serious sexual assault and rape of a minor. The boy was also awarded 5,000 euros ($5,210) for his suffering.

The rape took place last December when Amir A. dragged the boy into the locker room at public swimming facility in Vienna. The man subsequently sexually assaulted the boy, who needed urgent treatment at the hospital and still suffers from post-traumatic stress disorder.

Amir A. confessed to the rape after getting arrested at the swimming pool. He admitted he knew the action was wrong, but that it was a “sexual emergency” sparked by a lack of sexual activity in recent months.
