GOP Sen. Lindsey Graham had tough words for his Democratic colleagues on the Senate Committee on the Judiciary, as the third day of Judge Neil Gorsuch’s confirmation hearings began.

Graham objected to committee Democrats attempting to ascertain Gorsuch’s views on high profile controversies in the law, arguing Democrats had been far more accommodating of judicial appointees made by President Barack Obama. He read from comments Democratic Sen. Patrick Leahy of Vermont made during a previous confirmation hearing, in which he said it would be inappropriate to attempt to determine how a nominee would rule as a Supreme Court justice.

WATCH:

“‘I certainly don’t want you to have to lay out a test here in the abstract which might determine what your vote or your test would be in a case you have yet to see that may well come before the Supreme Court,'” Graham said, quoting Leahy. “That’s the standard when there is a Democratic nominee.”

“Now, when there is a Republican nominee, you’ve got to tell these senators that you won’t get in the way of their agenda,” he added. “I’m not asking you to tell me whether or not you agree with my agenda, I’m asking you whether or not you will fairly hear the cases before you, because to do anything else would be unfair to you.”

As Democratic Sen. Dick Durbin noted later in the hearing, the task of the respective parties changes with each hearing. Where the president’s party generally tosses softball questions, the opposition party asks more probing questions.
