Department of Justice spokeswoman Sarah Isgur Flores said the DOJ will look at retrying Democratic Sen. Bob Menendez after his corruption trial ended in a mistrial.

Menendez was on trial for corruption and bribery, and the prosecution argued that Menendez had done political favors for his friend Dr. Salomon Melgen in exchange for campaign donations and lavish gifts and vacations. The jury deliberated on the case for nearly two weeks before deciding they were unable to reach a unanimous decision.

Isgur Flores said on Fox News on Friday that the DOJ is interested in retrying the case, suggesting the mistrial could be just a temporary victory for Menendez.

“We’re going to look at retrying that case,” she said. “It’s always disappointing when you don’t win in court but Bob Menendez was facing several bribery and corruption charges and those are serious allegations.”

Fox anchor Steve Doocy noted that 10 out of 12 jurors were reportedly in favor of acquittal, and wondered if the case was worth retrying.

Isgur Flores explained that the DOJ will look at the arguments that were made in the case and if they can get a better jury, but said she was encouraged by the fact that the jury deliberated for several days and that Menendez was indicted in the first place.
