Police say that just south of Tocoma, Washington, a drunken, naked man with three prior DUIs drove his vehicle into tree while he was having sex with a woman, the Associated Press report.
According to police, the woman’s three-month-old child was in the back seat of the car.
Washington State Patrol spokesperson Brooke Bova said the crash happened around 6 p.m. last Wednesday. According to Bova and eyewitnesses, the child’s mother was also naked when she exited the crashed vehicle. She was hospitalized and treated for broken bones, but her three-month-old child miraculously survived without any injuries.
When police arrived, the driver of the vehicle was arrested, charged with a DUI, vehicular assault and child endangerment, The News Tribune reports. It is unclear whether or not the woman faces any charges.
Because the man had three prior DUIs and there was a child in the vehicle with him, this DUI charge is a felony. In Washington, a felony DUI charge alone is punishable by up to five years in prison and a $10,000 fine.
The child endangerment charge could constitute another class C felony, which would have the same range of punishments. Lastly, vehicular assault is charged as a class B felony, which could result in a prison sentence of 10 years and a $20,000 fine.
