CNN continued to beat the drum for the Stormy Daniels payoff story Thursday on “New Day,” but admitted there’s no proof of a crime being committed.
The network’s chief legal analyst Jeffrey Toobin accused the White House of lying to the American people, but said the case lacks a “criminal element.”
“How stupid do they think we are?” Toobin said. “They’ve been lying about this from day one. I am not clear that there was any criminal violation here. I haven’t been clear from the start.”
Toobin said even if the $130,000 President Donald Trump repaid to Michael Cohen was campaign related, it is seldom prosecuted in court and doesn’t carry much legal weight.
“Even if it was campaign related, that’s a very esoteric crime that is rarely prosecuted,” he said. “But the fact that everyone involved in the White House, starting with the president, has been lying about this from day one — it is just so extraordinary.”
“The absence of any kind of sheepishness about that, that to me is the real story,” Toobin concluded. “Which is the lying to the American people. Less so any potential criminal violation.”
