When wills or trust documents are challenged post-mortem, the burden of justifying a deviation falls on those provoking the change, not on those who are defending the written text. Courts make every effort to ensure that the wishes of the deceased are honored and, in disputed cases, use all available evidence and a fair adversarial process to reach a “best guess” decision. When those challenging a will or trust are powerful government officials acting in concert with some of the largest elite “charitable” organizations in the world — and the prize they are seeking is control of tens of billions of dollars worth of art — we’re still living in the Wild West.
