Balko doesn’t name any names, so I’m not sure who’s saying this. I know I haven’t. An accusation of rape, or any other crime, is not its own proof.
But in this particular case, even defense attorney Hillary Clinton found the accuser credible. She said that when her client passed a polygraph test, she was convinced he was lying anyway. If the cops hadn’t bungled the evidence, she seems to think he would’ve been convicted.
Whereas the Duke lacrosse team was found guilty by the media, there was no evidence to support the accuser’s claim, and the DA was disbarred for his misconduct of the case. Details, details.
Other than that, Mr. Balko makes an expert analogy. I look forward to finding out more about how this 12-year-old girl not only faked her own rape, but beat herself into a 5-day coma. Because:
