An Albuquerque man was enjoying a lazy Sunday when he was unexpectedly shot by police.

An officer, gun in hand, was climbing through a second story apartment window to investigate a burglary. That’s when the gun went off. The stray bullet went through the floor below and hit a man in the back, reports the Albuquerque Journal.

Despite having a rude surprise on his Sunday, the man is in stable condition with no life-threatening injuries.

“I want to emphasize this was an accidental shooting,” police spokesman Simon Drobik told the Albuquerque Journal. “The officer involved in this is just torn up.”

Police arrested a different man in connection with the burglary.
