A Montana cop who fatally shot an unarmed man earlier this year will likely not face charges.

A jury ruled on Wednesday that Billings police officer Grant Morrison was justified in the killing, The Associated Press reports. The family says their son was a victim of racial profiling, but the officer said the victim reached for his waist, and he thought he had a gun.

Morrison fatally shot another man in 2013, but that killing was also considered justified.

In a dash cam video appearing to show the incident, Morrison pulled over a car with four people inside and asked them to raise their hands.

Richard Ramirez, 38, was high on meth in the backseat, and appears to repeatedly disobey the order. He then reached down towards his waistband and Morrison fired three shots.

“I will shoot you again!” he yells. “Hands up!”

A different video shows Morrison minutes after the shooting. You can hear heavy breathing and one officer consoling him.

Ramirez family members told AP that they plan to sue Morrison and the police department.
