Refugee Wins Lawsuit Against Germany For Not Processing Him Fast Enough

A Somalian refugee who has been waiting on asylum in Germany for over a year has won a lawsuit against the the Federal Bureau of Migration and Refugees (BAMF).

The man filed a lawsuit against BAMF in July last year after waiting on an outcome for a month, Der Welt reports. The court ruled that it is reasonable for asylum seekers to expect a decision within three months of applying. Under extreme circumstances, such as the current migration stream from Syria, six months may be allowed.

BAMF may now have to pay out compensation if the man hasn’t received a decision within 90 days. The agency is worried that it won’t be able to make it happen since it has over 250,000 pending applications, a number that continues to increase as more asylum seekers pour in. The attorney of the Somalian man said he doesn’t see the logic in that argument and advises BAMF to hire more people if it can’t handle the work, according to Welt.

Around 20 Syrian refugees filed a similar lawsuit earlier this week after they got tired of waiting on social benefits and were struggling to support themselves. Germany received 173,100 asylum applications in 2014 and is expecting an additional million to have arrived by the end of 2015.
