A Cuyahoga County grand jury declined to charge Officers Timothy Loehmann and Frank Garmback with any criminal misconduct in the death of 12-year-old Tamir Rice on Monday.

Prosecutor Tim McGinty noted that though the situation was “undeniably tragic,” “the state must be able to show that the officers acted outside the constitutional boundaries set forth by the Supreme Court.”

“Simply put,” McGinty continued, “given this perfect storm of human error, mistakes and miscommunications by all involved that day, the evidence did not indicate criminal conduct by police.”

The shooting happened on Nov. 22, 2014.
