U.S. Supreme Court Justice Ruth Bader Ginsburg coyly predicted former Secretary of State Hillary Clinton will win the presidential election in November — a rare political intervention from a member of the high court.
“‘It’s likely that the next president, whoever she will be, will have a few appointments to make,’ Ginsburg said with a smile,” according to a report from the Associated Press Friday. Ginsburg sat for an interview with the AP in her Supreme Court chambers earlier this week.
She also shuddered at the possibility of a Donald Trump presidency.
“I don’t want to think about that possibility, but if it should be, then everything is up for grabs,” she said of the presumptive Republican nominee.
The justices of the Supreme Court attempt to remain apolitical, but Ginsburg’s comments, though surprisingly candid, are not necessarily unethical. The Supreme Court is not bound by any code of judicial conduct.
Houston College of Law Professor Josh Blackman also pointed out that other justices have engaged in similar election gamesmanship. Justice Sandra Day O’Connor’s cooed for George W. Bush at an election night party in 2000, which has been widely circulated. Chief Justice William Rehnquist also managed betting polls among the justices during campaign season.
