A notice set to be published in the Federal Register Thursday dictates federal buildings must let transgenders use the bathroom according to their “gender identity.”

Buildings controlled by the General Services Administration (GSA) are affected by this notice, reports The Hill. The notice pertains to the approximately 9,000 buildings and offices under the GSA.

“Federal agencies occupying space under the jurisdiction, custody, or control of GSA must allow individuals to use restroom facilities and related areas consistent with their gender identity,” the notice reads.

A GSA official said that the publication of the notice is meant, “to clarify that discrimination on the basis of gender identity is prohibited as sex discrimination.”

The notice affects the offices of agencies like the Social Security Administration and the Department of Veterans Affairs, as well as federal courthouses. The rule does not apply to national parks or to the U.S. Capitol building.

The notice also states that the agencies cannot ask for proof of a person having undergone a sex change or insist that a person be in the process of having one.

“The self-identification of gender identity by any individual is sufficient to establish which restroom or other single-sex facilities should be used,” the notice declares.

GSA officials state that the notice was issued after examining Departments of Education and Justice and the Equal Employment Opportunity Commission rulings.
