Judge Bans Man From Having Sex As Punishment For Rape

An Idaho man is banned from having sex before marriage as punishment for raping a teenage girl.

Idaho Judge Randy Stoker gave Cody Duane Scott Herrera, 19, a five to 15 year sentence for taking a 14-year-old girl’s virginity, reports KTVB.

Stoker suspended the sentence provided Herrera completes a one-year rider program. The program allows Herrera to be out on probation, but he must refrain from sex until he gets married.

Stoker believes that Herrera needs this type of program because of the many sexual partners he admitted to having. Herrera reportedly told investigators that he’s slept with 34 people.

“If you’re ever on probation with this court, a condition of that will be you will not have sexual relations with anyone except who you’re married to, if you’re married,” Stoker explained to Herrera.

Herrera confessed to raping a 14-year-old girl last March.

“It was his intent from the beginning to take what he wanted from my 14-year-old child — her virginity,” the girl’s mother said.

One college professor believes that the ruling could be illegal. Shaakirrah R. Sanders, an associate professor at the University of Idaho College of Law, said that decision could violate Herrera’s rights.

“I think it infringes on his constitutional rights,” she said. “I think if he appealed, he would win.”
