Attorney General Jeff Sessions needs to hire a private attorney from outside the Department of Justice to help with his legal battles, Judge Andrew Napolitano said Wednesday on Fox News’ “Outnumbered.”

In light of Sessions’s testimony before the Senate Judiciary Committee, Napolitano was asked if the attorney general should retain private counsel. “I think he needs an unbiased, non Justice Department, bright legal mind to help him sift through some of these things,” Napolitano responded. “It wouldn’t be unprecedented.”

Napolitano thinks that Sessions is getting boxed in by repeated legal inquires, and said the attorney general is close to committing a crime by misleading Congress.

“The Attorney general is in a little bit of a box. He’s already the attorney general. He doesn’t need their approval to stay in office. But he knows he’s sworn to tell the truth. He also knows he cannot mislead them,” Napolitano said. “So sometimes telling a sterile, brief truth can leave a misleading interpretation in the mind of the questioner.”

“That is an independent crime,” he added. “Misleading Congress, and he can’t do that.”
