Another illegal immigrant can now have an abortion after President Donald Trump’s administration released the girl from custody on Sunday.
Known as Jane Moe, the Department of Health and Human Services released the minor illegal immigrant. The American Civil Liberties Union (ACLU) is representing the girl.
Moe was scheduled to be released by Friday, Jan. 26, but was released early after the ACLU intervened on her behalf.
The Department of Health and Human Services’ Office of Refugee Resettlement sought to prevent Moe from obtaining an abortion, but the ACLU stepped in, asking the District of Columbia’s U.S. District Court to grant a temporary restraining order so that she could abort her child, according to the Hill.
“While we are relieved that Jane Moe is reunited with her sponsor, the government blocked her from her abortion for more than two weeks, before deliberately moving her out of their custody only when we filed to take them to court,” the ACLU’s Reproductive Freedom Project senior staff attorney, Brigitte Amiri, said in a statement.
“We continue to pursue all avenues to ensure that no other young woman like her is forced to continue a pregnancy against her will for purely political reasons,” Amiri added.
Moe’s release follows an ongoing battle concerning two illegal immigrants, aged 17 and 19, who asked the federal government to let them have abortions, The Hill reported in December. ACLU lawyers represented the two teens — Jane Roe and Jane Poe who were 10 weeks and 22 weeks pregnant, respectively — in court. Similar to Moe’s case, the Trump administration appealed U.S. District Judge Tanya Chutkan’s decision to issue a temporary restraining order against administration officials. The Trump administration tried to prevent the two illegal immigrants from having abortions, but were unsuccessful. Chutkan also ruled in late October that pregnant illegal immigrant Jane Doe — who was in custody in Texas — could get an abortion, according to Politico. The girl, 17, crossed the border illegally and was roughly 15 weeks pregnant when she had her abortion Oct. 25.
Moe is the fourth illegal immigrant who has asked the Trump administration to provide her with an abortion.
