Fox News senior judicial analyst Judge Andrew Napolitano said Chief Justice John Roberts will vote to keep abortion rights in place, despite being a pro-life Catholic.
“It is settled law and it is a precedent whether you like it or not,” Napolitano said on “America’s Newsroom” Monday. “I don’t think [Roe v. “The Chief Justice, though a practicing Catholic and pro-life himself does not believe that fundamental changes should come about in the court — the court’s decisions because of an election,” he continued.

Napolitano expects liberals to use abortion as a rally cry for the midterms and said an overly pro-life nominee will experience backlash during their confirmation hearing.
“The Democrats will make it the number one issue because two-thirds of the American public wants some form of abortion,” he concluded. “If the president nominates someone who puts a line in the sand not in his or her hearings but at some point in the past, that’s going to give the Democrats some ammunition.”
