Fox News senior judicial analyst Judge Andrew Napolitano said it would be politically “catastrophic” for President Donald Trump to plead the Fifth Amendment when he speaks to special counsel Robert Mueller.

Napolitano believes Trump’s attorney Rudy Giuliani is caught in a cat and mouse game with Mueller and has to play his cards right if he wants to exonerate the president. (RELATED: Judge Napolitano Says Trump Is More Interested In Character Of Judge Than Their Views On Roe v. Wade)

“It’s a sophisticated way to challenge Bob Mueller and to basically say ‘I’m not producing my client’ because he knows come heaven or high water that Bob Mueller won’t show his cards to him,” Napolitano said on “Mornings with Maria” Monday. “The downside to this is, they’ll slap a subpoena on the president. Bring him before the grand jury and Rudy won’t be there to whisper in his ear.”

“He can [plead the Fifth] but that would be catastrophic politically,” Napolitano concluded. “[Trump] has derided people for pleading the Fifth. You can find quotes of the president saying only the mob pleads the Fifth. Only the guilty plead the Fifth.”
