Ohio’s newest abortion clinic had not even been open for two weeks before getting sued over violating its contract.
Downtown Gynecologists Inc. (DGI) and Twelve Forty Three Company filed a civil suit in Franklin County Common Pleas Court against abortion clinic, Your Choice Healthcare, The Columbus Dispatch reported Thursday.
Twelve Forty Three Company owns Founder’s Women’s Health Center, which DGI operates.
The plaintiffs allege that Your Choice Healthcare violated its lease agreement as well as its non-compete contract and asked the court the shut down the clinic’s operations.
DGI claims that Your Choice Healthcare used DGI assets from the Women’s Health Center including phone numbers, policy forms and website material. The allegations come after T&S Management company separated from DGI and subsequently opened Your Choice Healthcare abortion clinic.
“They thought they had rights to assets, (DGI) thought we had rights to assets, so it’s up to the court to decide now,” DGI’s attorney, Barry Wolinetz, said.
Your Choice Healthcare opened July 9 on the Northeast Side of Columbus, Ohio, and offers medication abortions but no surgical abortions. A few days after its opening, NARAL Pro-Choice Ohio Executive Director Kellie Copeland said that the clinic isn’t really an abortion clinic because it doesn’t provide surgical abortions, WKSU reported.
The lawsuit asks for damages amounting to at least $100,000 as well as a jury trial. The suit also seeks to bar Your Choice Healthcare from competing with DGI in Franklin county and counties that surround it.
Other abortion clinics in Ohio have faced penalties for violating the law. Toledo Capital Care faces a $40,000 fine following an April, 2017 Ohio Department of Health (DOH) inspection revealing that the clinic staffed failed to follow its own emergency procedure, according to The Blade. In addition to the clinic violating emergency procedure, the clinic also failed to provide the paperwork requested by Ohio’s DOH on April 11, 2017. State inspectors also found 24 violations at the Toledo abortion clinic in the past 10 years, according to The Columbus Dispatch.
