‘Obvious Where He Stands’: Conservative Groups Criticize Biden’s Failure To Reject Court Packing

Conservative leaders and groups highlighted 2020 presidential candidate Joe Biden’s failure to reject court-packing in the first presidential debate.

The former vice president refused to say whether or not he would pack the Supreme Court during the Tuesday night debate, saying, “Whatever the position I take, that will be the issue. The issue is the American people should speak. You should go out and vote. You are voting now. Vote and let your senators know how strongly you feel. Vote now. Make sure you in fact let people know.”

Judicial Crisis Network’s Carrie Severino said that “left-wing groups have already issued a proposed SCOTUS list and it’s loaded with progressive activists.” (RELATED: Joe Biden Changes His Tune On Packing The Supreme Court)

“Joe Biden continues to dodge, weave, and refuse to commit that he will not pack the Supreme Court, as the leftist extremists in his party are demanding,” Severino tweeted.

“Democrats want to replace our current Supreme Court with a liberal super-legislature, stacked with politicians-turned-judges in the mold of AOC, Nancy Pelosi, Bernie Sanders and Elizabeth Warren. All with lifetime appointments, rewriting the law and Constitution.”

Turning Point USA Founder Charlie Kirk said that major Democratic leaders, including Biden’s running mate Kamala Harris, “have all called for packing the court and eliminating the filibuster.”

TeaParty Patriots co-founder Jenny Beth Martin said, “In last night’s debate, Joe Biden refused to say he would oppose packing with the Supreme Court with more liberal justices. That’s an idea so bad that when FDR tried it in 1937, he couldn’t get it done — even though Dems outnumbered GOPers in the Senate by 76-16.”

Conservative think tank The Heritage Foundation’s action arm also tweeted that Biden’s “lack of response should worry every American—there’s obviously something he doesn’t want to tell us.”

“Packing the court would essentially turn the Supreme Court into a mini—but super powerful—liberal legislature,” Heritage Action said in a series of tweets. “Activist judges, not elected or held accountable by the people, would begin legislating from the bench.”

The think tank’s action arm said that in the 1930s, Democrats refused former President Franklin D. Roosevelt’s request to expand the Supreme Court because they knew that “packing the court would not only undermine the legitimacy of the judicial branch but it would also endanger our democratic processes.”

“Packing the Supreme Court would take political debate out of Congress, the body of Government closest to the people,” Heritage Action added. “Americans of all walks of life should oppose this short-sighted and terrible idea.”
