Judge Issues Order Stopping Three Georgia Counties From Deleting Dominion Voting Data

U.S. District Judge Timothy C. Batten Sr. ordered Sunday that Dominion voting machines in Cobb, Gwinnett and Cherokee Counties in Georgia cannot erase any data after Republican nominees to the Electoral College filed an emergency motion seeking to inspect the machines and data.

Batten ordered the Defendants, which include Republican Gov. Brian Kemp and Secretary of State Brad Raffensperger, to file a brief by Wednesday that sets forth “in detail the factual bases they have, if any, against allowing the three forensic inspections.”

“Defendants are hereby ENJOINED and RESTRAINED from altering, destroying, or erasing, or allowing the alteration, destruction, or erasure of, any software or data on any Dominion voting machine in Cobb, Gwinnett, and Cherokee Counties.”

The plaintiffs, which include conservative teen pundit C.J. Pearson, allege that thousands of votes that went to President-elect Joe Biden’s final tally were ‘illegal’ and that the machines need to be inspected to ensure that no votes were illegally cast.

“Tens of thousands of votes counted toward Vice President Biden’s final tally were the product of illegality, and physical and computer-based fraud leading to ‘outright ballot stuffing’,” the Plaintiffs wrote Friday in their emergency request.

The Republican Electoral College nominees alleged Friday “resetting the machines would destroy relevant evidence.” The request alleges that 96,600 mail-in votes were illegally cast. (RELATED: Republican Georgia Secretary Of State Slams ‘Dishonest Actors’ For ‘Misleading’ POTUS On Dominion)

“Georgia’s election process depends entirely on voting machines, tabulators and software purchased from Dominion Voting Systems Corporation that was compromised,” the request continues.

“Computerized vote recording and tabulations are controlled by software programs that were designed to cheat, and which were open to human manipulation. In 2020, ballot stuffing is not simply counting votes of dead people, illegal aliens or out of state residents – all of which clearly occurred here.”

Counsel for the Defendant’s argue that forensic inspections “would pose substantial security and proprietary/trade secret risks to Defendants,” according to Sunday’s order.

However, the Plaintiffs said they could alleviate any concerns by allowing Defendants’ to bring their own experts to take part in the video-recorded inspections and allow the experts to give whatever information they recover solely to the court, according to the order.

Pearson celebrated the order in a tweet Sunday, saying “WE WILL STOP THE STEAL.”
