THE SUPREME COURT IS BACK IN SESSION… NYT: Back on the Bench, the Supreme Court Faces a Blockbuster Term

The marquee arguments will take place in the fall. On Nov. 3, the court will consider the constitutionality of a New York law that imposes strict limits on carrying guns outside the home. The court has not issued a major Second Amendment ruling in more than a decade, and it has said next to nothing about the right to bear arms in public. […]

On Dec. 1, the court will hear arguments in Dobbs v. Jackson Women’s Health Organization, No. 19-1392, a challenge to a Mississippi law that seeks to ban most abortions after 15 weeks of pregnancy — about two months earlier than Roe and subsequent decisions allow. […]

But there are plenty of other significant cases on the docket. On Wednesday, for instance, the justices will hear arguments in United States v. Abu Zubaydah, No. 20-827, a case about whether the government can block a detainee at Guantánamo Bay from obtaining information from two former C.I.A. contractors involved in torturing him on the ground that it would expose state secrets.

A week later, in United States v. Tsarnaev, No. 20-443, the court will review an appeals court’s decision that threw out the death sentence of Dzhokhar A. Tsarnaev, who was convicted of helping carry out the Boston Marathon bombings in 2013.

On Nov. 1, in another death-penalty case, Ramirez v. Collier, No. 21-5592, the court will hear a request from a condemned inmate in Texas for his pastor to be able to touch him and to pray aloud with him in the death chamber.

In its last scheduled argument this year, on Dec. 8, the court will hear Carson v. Makin, No. 20-1088, a dispute over whether Maine may exclude religious schools that offer sectarian education from a state tuition program.

NEW CROSSING ZONE FOR HAITIAN ILLEGALS… KAREN TOWNSEND: Remote Arizona crossing is the newest hot spot for Haitian migrants

A little-known area outside of Yuma, Arizona is becoming a popular crossing spot for illegal Haitian migrants. The remote area is referred to as The Gap because it is a break in the border fence close to the Morelos Dam. The break allows migrants an easy crossing of the Colorado River from Los Algodones in Mexico. The Yuma sector is reporting that the crossings are relentless and happening twenty-four hours a day, seven days a week.

The number of illegal aliens is exploding and the Border Patrol facilities are overwhelmed. While we’ve been focused on areas like Del Rio, Texas, for obvious reasons, other hot spots are popping up. So far, there has been a 2,399.6% spike in arrivals compared to this time last year, with up to 900 people crossing each day. They are not just Haitians but also from Colombia and Honduras. Word has been spread that The Gap is the place to go for easy entry.

BIDEN RAPIDLY SHEDDING KEY CONSTITUENCIES… NYT: Biden’s Slide With Key Voters: Momentary Blip or Danger Sign?

President Biden’s approval rating among key Democratic constituencies has declined considerably in recent months, eroding or even reversing decades-long patterns in public opinion. […]

A large number of voters — women, young people and those who are Black or Latino — have all soured on Mr. Biden’s performance[…]

WOMEN… Mr. Biden’s ratings have fallen more among women than any other demographic group. Forty-eight percent of women approve of Mr. Biden’s performance in polls conducted since the fall of Kabul, down from 57 percent in earlier surveys by the same national pollsters. […]

YOUNG PEOPLE… The president’s ratings have fallen to around 45 percent among 18- to 34-year-olds, while his rating holds at around 48 percent among seniors, entirely closing and even slightly reversing the generation gap evident in recent elections. […]

BLACK… Polls from the Pew Research Center, Quinnipiac University and Morning Consult all found Mr. Biden’s approval rating slipping into the low 70s or 60s among Black voters, a weak performance for any Democrat. […]

LATINO… At the same time, the polls show Mr. Biden’s ratings among Latino voters slipping close to or beneath 50 percent. A new Quinnipiac poll in Texas even showed Mr. Biden’s ratings in the 30s among Latino voters in the state. It’s not what Democrats want to see after Mr. Biden’s disappointing performance among the group last November. […]

WHITE… Mr. Biden’s support has held up among white college graduates, according to the recent polls, while his standing among white voters without a degree has dropped to 30 percent, down from 37 percent in polls taken in June and July.

NATE COHN: Biden’s approval rating among Texas Hispanics is at 36% in the latest Quinnipiac poll, with a 26% approval on his handling of the border

BIDEN CRATERS WITH INDEPENDENT VOTERS, BLACK VOTERS… JAZZ SHAW: Biden’s approval among Black voters plunges more than 20 points in one month

So AP/NORC still has Biden at 50/49 while the majority of polling outlets are showing him being underwater. As I said, that’s probably par for the course, but it’s a very low number to drop to this soon in a first presidential term. Support among Democrats is still strong, but it dropped from 92 to 85 percent. The AP describes this as having “dipped slightly,” but they curiously apply the same label to his support from the critical category of independent voters. That’s one area where Biden actually cratered, falling from 62 to 38 percent. The only party demographic where he stayed the same was with Republicans, where he has the same 11% support he had last time.

The real eye-openers came with the shift in support along racial lines. Biden is doing slightly worse with white voters, falling from 49% to 42%. But with Black voters, one of the key demographics he relied on in 2020, his support absolutely tanked, dropping from 86% to 64%. It’s hard to imagine this being attributable to much beyond his vaccine mandates and protests against those policies coming from Black Lives Matter. If Joe slips much further and actually goes underwater with Black voters he can pretty much forget about any future election chances. No Democrat can survive with those sorts of numbers.

NASCAR Fans Chant ‘F**k Joe Biden’
During Race At Talladega Superspeedway (VIDEO)

Some NASCAR fans let it be known Saturday they’re not big fans of President Joe Biden.

Following Brandon Brown winning an Xfinity Series race at Talladega Superspeedway, fans broke out into a “F**k Joe Biden” chant while he was being interviewed.

NBC REPORTER THINKS IT’S SOMETHING ELSE… DONALD TRUMP JR: I’m pretty sure they’re not chanting “Let’s go Brandon” as the NBC reporter is telling us. (VIDEO)

PROTESTERS HARASS KYRSTEN SINEMA AS SHE’S ENTERING BATHROOM STALL… JENNIFER EPSTEIN: Protesters followed Sen. Sinema into the bathroom at Arizona State University to confront her on Build Back Better and immigration (VIDEO)

POTTY PROTESTERS DEMAND AMNESTY FOR ILLEGALS… FOX: Sinema confronted by immigration activists in a bathroom

Sen. Kyrsten Sinema was confronted by immigration activists who followed the senator from the classroom where she teaches at Arizona State University to the bathroom while demanding the Arizona Democrat take action on a “pathway to citizenship.”

“We knocked on doors for you to get you elected. Just how we got you elected, we can get you out of office if you don’t support what you promised us,” one of the activists said to Sinema in the video that was recorded with a phone.

The activists first confronted Sinema at her ASU classroom, then followed her down the hall as the senator went into the bathroom and shut the door of a stall. Nevertheless, the activists continued to voice their demands from inside the bathroom, including a demand that she support President Biden’s “Build Back Better” agenda and legislation that would provide a pathway to citizenship for illegal migrants.

“We need the Build Back Better plan right now,” one activist said.

BRENT SCHER: How long would the news cycle be fixated on a conservative activist cornering AOC in a bathroom? A year? Maybe two?

PROTESTERS CONFRONT MANCHIN AT HOME… Protesters In Kayaks Swarm Joe Manchin’s Yacht To Tell Him $3.5 Trillion ‘Isn’t Spending’ (VIDEO)

Protesters in kayaks on Friday demanded a meeting with Democratic West Virginia Sen. Joe Manchin because he refused to back the $3.5 trillion spending bill.

Using a megaphone, one of the protestors shouted, “Senator, this is an investment. This is not giving out money. This is not spending! This is investing and this is building the state that we both love. That’s why we’re both here fighting for our people because we love West Virginia and we believe in our state! We need you to stand with us!”

“I appreciate that very much,” Manchin responded. Manchin and Arizona Sen. Kyrsten Sinema are the only two Democrats who do not support the spending bill.

“I appreciate that and I respect that, you know,” Manchin added. “Some of the neighbors are complaining. That’s all I’m saying. If you want to talk, I’m happy to talk. And, don’t harass the neighbors. Be nice. Let’s talk about it.”

Alexandria Ocasio-Cortez Says Neither Infrastructure Nor Reconciliation Bill Will Pass If Congress Separates Them (VIDEO)

Democratic New York Rep. Alexandria Ocasio-Cortez said Sunday that the $1.2 trillion infrastructure bill was initially tied with the much larger reconciliation bill, so neither bill will pass “if people try to separate them.”

Ocasio-Cortez appeared Sunday on CBS News’ “Face The Nation,” where she was asked to remark on some of House Democrats’ comments about her “not playing for the team” by holding the infrastructure bill hostage in an attempt to push the $3.5 trillion Build Back Better Act.

“Well, the agreement several months ago to even proceed on that one bipartisan bill was that it was tied with our larger Build Back Better agenda,” Ocasio-Cortez responded.

“[S]ome folks say, ‘why don’t you just pass this and we’ll see everything else later?’ Well, first of all, both of the bills need to pass. Both will not pass if people try to separate them. If we try to diverge from that agreement that was settled several months ago,” she added.

FLASHBACK… REPUBLICANS WHO NEGOTIATED INFRASTRUCTURE WERE APPALLED WHEN BIDEN LINKED BOTH PACKAGES… JUNE 25… WAPO: GOP senators are furious over Biden pledge tying infrastructure bill to huge Democratic package

“It completely violates the spirit of the deal. The Republicans involved in negotiations feel betrayed and made fools of for agreeing to a deal in which the Democrats will ultimately get everything they want,” said Brian Riedl, a former aide to Sen. Rob Portman (R-Ohio), who helped lead the discussions. “Moderate Republicans had an understanding that they were scaling down the cost of the final deal, not simply transferring that cost to a second bill.”

FAUCI IS THIS CLOSE TO CANCELLING CHRISTMAS AGAIN… Margaret Brennan: “We can gather for Christmas, or it’s just too soon to tell?” Fauci: “You know, Margaret, it’s just too soon to tell. We’ve just gotta concentrating on continuing to get those numbers down, & not try to jump ahead by weeks or months…” (VIDEO)

MARY KATHARINE HAM: He said at an Atlantic event this week that he rejects the idea that even moderate or mild COVID infection is okay when that’s exactly what we’re told is the purpose of vax (as opposed to preventing transmission entirely). His philosophy is not compatible with a free society.

FLASHBACK… DEC 16, 2020… FOX: Fauci tells Americans not to see their kids for Christmas

Dr. Anthony Fauci, the nation’s top infectious disease expert, said this week that he and his wife will not be seeing his three adult children for Christmas or for his birthday on Christmas Eve amid the ongoing coronavirus pandemic, and urged other Americans to do the same. […]

“Stay at home as much as you can, keep your interactions to the extent possible to members of the same household,” Fauci said. “This cannot be business as usual this Christmas because we’re already in a very difficult situation, and we’re going to make it worse, if we don’t do something about it.”

Fauci urged resilience, qualifying that the pandemic is “an unusual situation” and is “not going to last forever.”

“It is highly likely that with vaccines being distributed, that we will be back to normal by next Christmas,” Fauci said.

FAUCI EXCUSES ILLEGAL BORDER CROSSERS… Fauci Says Illegal Immigrants Aren’t Behind New COVID-19 Surges (VIDEO)

White House chief medical adviser Dr. Anthony Fauci rejected that the illegal immigrants coming across the southern border were at all responsible for the COVID-19 surges seen particularly in the south.

“The problem is within our own country,” Fauci said Sunday on CNN’s “State of the Union” with Jake Tapper and Dana Bash. “Certainly immigrants can get infected but they’re not the driving force of this.”

When asked about his opinion of Title 42, an order that allows immigration officials to expel migrants more quickly because of the pandemic, Fauci deflected, stating that he “wasn’t familiar with the intricacies of that rule.” He further stated that “focusing on immigrants, expelling them, is not the solution to an outbreak.”

LOUISIANA HOSPITAL SET TO FINE DOCS, NURSES WHOSE *SPOUSES* ARE UNVAXXED… DAILY MAIL: Louisiana’s largest hospital system will fine employees with unvaccinated spouses $200 a month if they don’t get Covid-19 vaccine by end of month

Louisiana’s largest health system is ratcheting up the pressure to get people vaccinated against COVID-19 and will start fining employees hundreds of dollars each month if they are married to someone who is unvaccinated.

Ochsner Health has told its workers it will charge them a monthly premium of $200 if a spouse or domestic partner covered under an Ochsner health plan have not been vaccinated.

Ochsner has said all employees must be vaccinated by October 29 to keep their jobs.

MARTY MAKARY: Fining doctors & nurses $200 if they have a unvaccinated spouse or partner at home?? This is backfiring, hardening people against vax. It’s also violation of HIPAA privacy law–if not the letter of the law, certainly the spirit of the law.

LT COL SCHELLER’S HEARING DELAYED A WEEK… WCPO: Hearing delayed for local Marine Stuart Scheller, while defense fund raises $2M

The U.S. Marine Corps and defense attorneys for Lt. Col. Stuart Scheller agreed to delay an Initial Officer Review hearing until next week, according to the Pipe Hitter Foundation, an organization founded by former Navy Seal Eddie Gallagher to raise legal defense funds for members of the military. An IRO review is held before a military court martial.

“The delay will allow both parties to seek a joint resolution of the matter,” the foundation stated in an Instagram post. “Lt. Col. Scheller said he was willing to continue his time in the brig in order to provide peace of mind to the command while allowing for negotiations to secure an honorable departure.”

UPDATE… BIDEN TO KEEP ENFORCING TRUMP’S CHINA TARIFFS… AXIOS: U.S. to warn China is not complying with Trump’s Phase One trade deal

U.S. Trade Representative Katherine Tai will declare Monday that an extensive review found China isn’t meeting its commitments under the Phase One trade deal — laying the groundwork for the Biden administration to keep in place Trump-era tariffs while considering other punitive actions. […]

Tai will detail the review’s findings in a speech at a Washington think tank Monday, marking her most extensive comments to date about the administration’s plans to address China’s “coercive” and “predatory” trade practices, according to officials who spoke to reporters on condition of anonymity to preview the remarks. […]

Tai will confront her Chinese counterpart on areas where the U.S. says Beijing has failed to comply with the terms of the agreement, such as its commitment to buy an additional $200 billion worth of U.S. goods over two years.

FACEBOOK EMPLOYEE REVEALS COMPANY DOCUMENTS IN PUSH FOR MORE CENSORSHIP… 60 MINUTES: Whistleblower: Facebook is misleading the public on progress against hate speech, violence, misinformation (VIDEO)

Frances Haugen is 37, a data scientist from Iowa with a degree in computer engineering and a Harvard master’s degree in business. For 15 years she’s worked for companies including Google and Pinterest. […]

She secretly copied tens of thousands of pages of Facebook internal research. She says evidence shows that the company is lying to the public about making significant progress against hate, violence and misinformation. One study she found, from this year, says, “we estimate that we may action as little as 3-5% of hate and about 6-tenths of 1% of V & I [violence and incitement] on Facebook despite being the best in the world at it.” […]

At headquarters, she was assigned to Civic Integrity which worked on risks to elections including misinformation. But after this past election, there was a turning point.

Frances Haugen: They told us, “We’re dissolving Civic Integrity.” Like, they basically said, “Oh good, we made it through the election. There wasn’t riots. We can get rid of Civic Integrity now.” Fast forward a couple months, we got the insurrection. And when they got rid of Civic Integrity, it was the moment where I was like, “I don’t trust that they’re willing to actually invest what needs to be invested to keep Facebook from being dangerous.” […]

Haugen says Facebook understood the danger to the 2020 Election. So, it turned on safety systems to reduce misinformation—but many of those changes, she says, were temporary.

Frances Haugen: And as soon as the election was over, they turned them back off or they changed the settings back to what they were before, to prioritize growth over safety.

And that really feels like a betrayal of democracy to me.

BRENT SCHER: This 60 Minutes piece on Facebook is a whistle blower critical about how the company STOPPED censoring as much content AFTER the election, proving it was all done for one reason.
