The Soros-backed Los Angeles County District Attorney has put in place a policy that requires that prosecutors weigh a suspect’s immigration status before issuing charges, according to Fox News.

George Gascon, who received 2.25 million from left-wing megadonor George Soros during his campaign, is seeking to protect illegal immigrant crime suspects from deportation, Fox News reported. Gascon has long received criticism for being lax on crime, which sparked an unsuccessful recall effort. “Whether it’s the Biden administration, or radical open-borders advocates in states like California, they all have one thing in common—they are choosing not to enforce immigration law and deport those here illegally,” former acting ICE Director Tom Homan, who is now a visiting fellow at the conservative Heritage Foundation, said in a statement shared with the Daily Caller News Foundation.

“In Gascon’s case, it’s even worse, because these are illegal aliens who have committed crimes, often against American citizens, in addition to breaking the law by remaining here illegally. The more we see these types of policies implemented by radical open-borders advocates, the more crime will go up, and the worse our border crisis will get—because these individuals know they won’t be deported,” Homan said.

The new policy encourages prosecutors to protect illegal immigrant suspects from “adverse immigration consequences” if they’re charged with crimes, according to Fox News.

“All charging determinations shall be undertaken with the goal of avoiding or mitigating the adverse immigration consequences of a decision when known, possible pr permitting,” the policy says, according to Fox News. “Under these circumstances and when, consistent with public safety alternatives to filing charges exist, those alternatives shall be pursued.”

Customs and Border Protection (CBP) encountered more than 2.3 million migrants in fiscal year 2022 and more than 230,000 in October, both are records for the agency, which is seeing a surge of illegal immigration in recent years. Federal border authorities also apprehended more than 800 individuals with gang ties between October 2021 and October 2022.

“The Los Angeles District Attorney’s Office consulted with our staff, community stakeholders and immigration experts to craft a comprehensive Immigration policy that protects vulnerable victims and prioritizes safety while attempting to avoid overly punitive consequences for the accused,” Tiffany Blackwell, communications director for Gascon’s office, told Fox News Digital.

“We believe that we have achieved that result. We will continue to rely upon our staff to provide us with relevant information that will assist in making the determination if alternative sentencing is warranted,” Blackwell said.

Gascon’s office didn’t respond to the DCNF’s request for comment.
