The parents and husband of cinematographer Halyna Hutchins, the victim fatally shot on the set of Alec Baldwin’s movie “Rust,” on Thursday filed new litigation against Alec Baldwin, TMZ reported.

Court documents indicate Baldwin is among numerous companies and individuals named in the newly filed lawsuit, according to TMZ. Armorer Hannah Gutierrez-Reed has also been named, as well as Director David Halls, who has been named as a defendant, TMZ reported.

The documents claim safety protocols were not followed and the family reportedly emphasized that Halls should have been the only one handing the gun to Baldwin, according to TMZ. The Hutchins family retained attorney Gloria Allred, who is expected to hold a press conference Thursday afternoon to provide more information on the new lawsuit.

Hutchins’ family is seeking unspecified damages and is reportedly suing for loss of consortium, negligence, and intentional infliction of emotional distress, according to TMZ.

The court documents reportedly indicate Baldwin “cannot hide” behind claims he was told the gun was “cold,” and state he should not have cocked or fired the gun during a rehearsal. The absence of sufficient plexiglass in the building has also been cited as a concern within the legal documents, according to TMZ.

Baldwin has been charged with involuntary manslaughter and is awaiting his first court appearance, according to Daily Mail.

Baldwin and other members of Rust Movie Productions, LLC., in October 2022 settled a wrongful death lawsuit filed by Hutchins’ husband, Matthew, ABC News reported. The settlement included Matthew being appointed as the executive producer on the movie when production started up again in January, according to the outlet. Baldwin has maintained his innocence throughout the ordeal, insisting he did not pull the trigger. “I would never point a gun at anyone and pull the trigger on them, never,” Baldwin previously told ABC in an interview.

Halyna Hutchins was a cinematographer for the movie “Rust” and was fatally shot when a prop gun held by Alec Baldwin fired during rehearsal. She died Oct. 21, 2021, and is survived by Matthew and their son Andros, who was nine years old at the time of his mother’s death, according to Today.
