Former U.S. attorney Chuck Rosenberg said Monday on MSNBC’s “Morning Joe” that former President Donald Trump should not be arrested and warned that, if he were, the fairness of the legal system could come into question.
Trump announced Saturday he expects to be arrested by the Manhattan District Attorney’s office on Tuesday. The potential indictment relates to a years-long investigation into whether Trump paid hush money to former porn actress Stormy Daniels. In Oct. 2016, Trump’s former lawyer, Michael Cohen, sent $130,000 to Daniels so that she would not disclose her alleged affair with Trump, according to reporting from The Wall Street Journal. Cohen claims that the then-candidate reimbursed him for the payments, and authorities are still investigating whether Trump forged business records to hide the alleged payout.
During the Monday morning segment on MSNBC, host Jonathan Lemire asked Rosenberg to walk viewers through what a possible Trump indictment would look like.
“First I don’t think he’ll be arrested, nor, frankly, do I think he ought to be arrested,” Rosenberg said. “Let me explain that: the reason you arrest people is because they’re dangerous or they might flee or because you’re going to move for their detention after they’ve been charged. I can’t imagine that the government here will move Mr. Trump’s detention, or even if they did, that a judge would grant it.”
“And so there is another way of getting somebody in front of a court: you ask them to self-surrender,” Rosenberg continued. “That’s what happened in the Weisselberg case, and with the other cases brought in the Manhattan district attorney’s office connected to Trump and some of his minions.” (RELATED: McCarthy Says Americans Should Not Protest If Trump Is Indicted)
Rosenberg suggested that Trump would likely be given the option to self-surrender, adding he doesn’t like the idea of Trump being placed in handcuffs.
“I don’t think it’s always appropriate. I know the media likes it because it’s a good shot, it’s a good visual,” Rosenberg continued. “And I’m not sure, given that we are talking about a former president, that they can’t make some other arrangement — not so much for his privacy, but for his security.”
“Absolutely,” co-host Mika Brzezinski interjected.
“I’m not a fan of Mr. Trump, but I do care about the security of anybody who’s been charged in the criminal justice system, as well as their dignity and the fairness with which they are treated,” Rosenberg added.
