WASHINGTON (AP) — AT&T and Justice Department attorneys trying to stop the company’s merger with T-Mobile have agreed that a former District of Columbia judge should arbitrate disputes over evidence as they prepare for trial.
The two sides asked U.S. District Judge Ellen Segal Huvelle on Thursday to name retired Superior Court Judge Richard Levie as special master in the case.
They want Levie to have authority to resolve disputes over the evidence they will have to exchange before the anti-trust trial scheduled for February. They propose discussing the issues weekly and that the two sides split the cost for Levie’s services and expenses.
Levie served as a judge from 1985-2000 and has been a professional arbitrator since 2004.
