Governor Mike Huckabee must pay $25,000 for playing the “Eye of the Tiger” at a rally last year.

On Monday, CNN learned that the former Republican presidential candidate must pay the fine for playing the song by the band Survivor after failing to get permission first to do so, a violation of copyright infringement. Huckabee played the famous fight song last year at a rally for Kim Davis, the county clerk in Kentucky that was jailed after refusing to issue marriage licenses for gay couples, following the Supreme Court’s ruling on gay marriage.

The former Governor of Arkansas had originally claimed the event was a “religious assembly” after she was let out of jail and not part of his presidential campaign and thus considered “fair use.”

However, that argument failed to hold up when the songwriter’s lawyer was able to show that Huckabee claimed the event as a campaign expense.
