Fox News senior judicial analyst Judge Andrew Napolitano thinks the immigration policy of catch and release is dead and said illegal immigrants will be “confined” by the Trump administration while they await hearings on their refugee status.

“Once they do knock on the door and say, ‘I’m a political refugee I came from Honduras where my husband’s being kept in jail because of his political views,’ that triggers an obligation on the part of the American officials there to examine this,” Napolitano said on “Fox & Friends” Tuesday.

“That examination doesn’t take five minutes, it takes five months. In the Obama administration, they just let you go and come back in five months. In the Trump administration, they’re going to keep you confined,” he continued.

Napolitano also said attorneys are being provided by independent immigration groups, not by the government and should help streamline the process.

“You’ll have a lawyer. The lawyers are being provided by immigration groups not by the government,” he concluded. “The lawyers will make actually make this work a little better. And there’ll be a mini trial before a judge to determine, are you truly a political refugee. If yes, you get to stay. If no they we’re sending you out.”
