Andy McCarthy Says Robert Hur Testimony Shows Why ‘Biden Should Pardon Trump’

Former federal prosecutor Andy McCarthy on Wednesday asserted President Joe Biden should pardon former President Donald Trump after special counsel Robert Hur’s Tuesday testimony.

Hur testified on his report that concluded there should be no charges against Biden despite him willfully withholding classified documents. Trump faces charges related to classified documents and Biden should pardon him to get rid of the alleged double standard, McCarthy asserted on “Fox and Friends.” (RELATED: Biden World’s ‘MAGA Guy’ Attack On Robert Hur Just Doesn’t Add Up, Records Show)

“So the main difference between this case and Trump’s case, they keep pointing to Trump didn’t cooperate and Biden did. What do you say to that?” Brian Kilmeade asked.

“That’s a terrible way of distinguishing them because cooperation is not a basis to not charge somebody. Like, for example, in a murder investigation, once the murderer knows he has been caught, it’s frequent that they will let you, you know, search the house, they will give you a statement,” McCarthy said. “They will be cooperative with the police. We don’t forgive the murderer in those circumstances.

“Cooperation is a sentencing issue. So, after you have been convicted, whether you plead guilty or get found guilty by a jury, then at sentencing, people will say, well, he was very cooperative with the investigators, and the court will take that into account, for what it’s worth, in fixing what the sentence should be. But, it has nothing to do with guilt,” he added.

Lawmakers on both sides of the aisle frequently discussed Trump and his classified documents during the hearing, with Republicans using the situation to emphasize an alleged double standard while Democrats highlighted differences in cooperation.

“Yesterday confirmed what I have been saying for a couple of months, which is that Biden should pardon Trump on the classified documents counts in the Florida case,” McCarthy told Kilmeade. “If they’re saying the difference between the two cases is that Trump obstructed and Biden didn’t, then forgive all of the classified information stuff across the board. Treat Trump and Biden the same way, and try Trump on obstruction.”
