A trio of House Republicans have introduced a new bill that seeks to guarantee due process when college students are accused of sexual assault, while also increasing the involvement of law enforcement in such cases.

The Safe Campus Act’s three sponsors are Reps. Matt Salmon of Arizona along with Pete Sessions and Kay Granger, both of Texas. All three are Republicans. The bill’s release coincides with renewed interest in the U.S. Senate over another bill intended to help prevent campus assaults. (RELATED: Senate Plans One-Sided Sexual Assault Panel)

Wednesday’s bill stands out by placing a strong emphasis on implementing due process provisions in campus judicial proceedings, while also trying to get the police more involved, so that colleges aren’t seen as the main agents for policing campus sexual assault.

The bill would make several major policy changes that would apply to all schools receiving federal funds:

  • Whenever a student claims to be the victim of a sex crime, such as rape, university officials would be required to ask if they want the police involved. If a person does, schools must provide the police 30 days of exclusive jurisdiction before taking any action themselves. If a student declines police involvement, then schools may only take limited action against the accused, such as requiring them to stay away from the accuser or altering housing assignments. They would not be allowed to launch their own investigation, expel a student or suspend them for greater than 30 days.
  • If a person does report their claim to the police, then after the 30-day period is exhausted colleges would be free to carry out an investigation of their own, whether police chose to press charges or not. These investigations would be allowed to punish an accused student with expulsion or a long-term suspension.
  • Any investigation would require a full hearing before it can levy a punishment. Both accuser and accused must receive at least two weeks notice to give them time to prepare.
  • In a hearing related to sexual assault, both the accuser and the accused would be guaranteed the right to hire attorneys if they wish. Both sides would also be given the right to question witnesses.
  • Universities would be allowed to choose what standard of proof they use for campus proceedings, as opposed to the current situation in which the Obama administration has required schools to use a low “preponderance of evidence” standard.
  • Accused students during campus adjudication would be guaranteed the right to see all evidence against them, as they would have in a criminal trial
  • Colleges would be barred from having people serve multiple roles in the investigative process. For example, a college employee serving as a
  • Students who are wrongfully expelled would be explicitly empowered to sue their schools for breach of contract

Overall, the bill is significantly greater in scope than the bill under consideration in the Senate, the Campus Accountability and Safety Act (CASA). That bill focuses on making it easier to punish schools that fail to address sexual assault, and also requires schools to conduct campus climate surveys in order to see whether students feel safe on campus.

Whether this bill can win support with its strong emphasis on due process is another matter. In particular, requiring students to report offenses to the police may upset many advocates for sexual assault victims, who argue that victims should have the option of trying to have an attacker removed from campus without having to go through difficult interactions with law enforcement.

Kirsten Gillibrand, who has been spearheading anti-sexual assault efforts in the Senate, has expressed support for applying lower due process standards to campus hearings, and has also expressed support for keeping campus proceedings separate from any involving the police.

The Daily Caller News Foundation reached out to Gillibrand’s office for comment on the House bill, but has not yet received a reply. (RELATED: Gillibrand: ‘Yes Means Yes’ Should Go Nationwide)

Civil liberties advocates, though, are happy with the bill. The Foundation for Individual Rights in Education (FIRE) praised the bill in a statement released Wednesday morning.

“The due process protections provided by the Safe Campus Act would enhance the reliability of campus proceedings and lend sorely needed credibility to their findings,” said FIRE legislative and policy director Joseph Cohn. Cohn said the right to have an attorney present, currently only codified in North Dakota and North Carolina, is especially important.

“The right to counsel is an important procedural protection not just for the accused, whose statements in campus proceedings can be admitted against them in subsequent criminal proceedings, but also for complainants,” Cohn said. “Institutions that are proceeding with expulsion hearings may not intentionally aim to sweep accusations under the rug, but they may still be incompetent in making the case against the accused and even complicate later criminal proceedings—because, again, they are not courts or law enforcement. By providing the complainant the right to have a lawyer who can, among other things, examine witnesses, complainants will also have more assurance that the questions they want asked will be asked.”

The bill has also received initial support from national bodies representing Greek life. Notably, the National Panhellenic Conference, which represents many sororities, strongly endorsed the bill, saying it addresses the problem of assault in a “balanced, just manner.”

Readers,

Instead of sucking up to the political and corporate powers that dominate America, The Daily Caller is fighting for you — our readers. We humbly ask you to consider joining us in this fight.

Now that millions of readers are rejecting the increasingly biased and even corrupt corporate media and joining us daily, there are powerful forces lined up to stop us: the old guard of the news media hopes to marginalize us; the big corporate ad agencies want to deprive us of revenue and put us out of business; senators threaten to have our reporters arrested for asking simple questions; the big tech platforms want to limit our ability to communicate with you; and the political party establishments feel threatened by our independence.

We don't complain -- we can't stand complainers -- but we do call it how we see it. We have a fight on our hands, and it's intense. We need your help to smash through the big tech, big media and big government blockade.

We're the insurgent outsiders for a reason: our deep-dive investigations hold the powerful to account. Our original videos undermine their narratives on a daily basis. Even our insistence on having fun infuriates them -- because we won’t bend the knee to political correctness.

One reason we stand apart is because we are not afraid to say we love America. We love her with every fiber of our being, and we think she's worth saving from today’s craziness.

Help us save her.

A second reason we stand out is the sheer number of honest responsible reporters we have helped train. We have trained so many solid reporters that they now hold prominent positions at publications across the political spectrum. Hear a rare reasonable voice at a place like CNN? There’s a good chance they were trained at Daily Caller. Same goes for the numerous Daily Caller alumni dominating the news coverage at outlets such as Fox News, Newsmax, Daily Wire and many others.

Simply put, America needs solid reporters fighting to tell the truth or we will never have honest elections or a fair system. We are working tirelessly to make that happen and we are making a difference.

Since 2010, The Daily Caller has grown immensely. We're in the halls of Congress. We're in the Oval Office. And we're in up to 20 million homes every single month. That's 20 million Americans like you who are impossible to ignore.

We can overcome the forces lined up against all of us. This is an important mission but we can’t do it unless you — the everyday Americans forgotten by the establishment — have our back.

Please consider becoming a Daily Caller Patriot today, and help us keep doing work that holds politicians, corporations and other leaders accountable. Help us thumb our noses at political correctness. Help us train a new generation of news reporters who will actually tell the truth. And help us remind Americans everywhere that there are millions of us who remain clear-eyed about our country's greatness.

In return for membership, Daily Caller Patriots will be able to read The Daily Caller without any of the ads that we have long used to support our mission. We know the ads drive you crazy. They drive us crazy too. But we need revenue to keep the fight going. If you join us, we will cut out the ads for you and put every Lincoln-headed cent we earn into amplifying our voice, training even more solid reporters, and giving you the ad-free experience and lightning fast website you deserve.

Patriots will also be eligible for Patriots Only content, newsletters, chats and live events with our reporters and editors. It's simple: welcome us into your lives, and we'll welcome you into ours.

We can save America together.

Become a Daily Caller Patriot today.
