Florida residents voted Tuesday to reject a constitutional amendment that would have enshrined the right to produce solar power while limiting the amount of subsidies paid out.

Almost 51 percent of voters supported the amendment, but the measure failed to win the 60 percent needed to amend Florida’s constitution.

Supporters claimed the measure would prevent individuals who don’t own solar panels from subsidizing those who do. Opponents said the proposal would have hurt rooftop solar companies by not allowing solar panel owners to get near retail rats for the electricity they generate.

The measure was not expected to pass, and still under-performed polls.

A recent poll published last week by Saint Leo University found about 59 percent of voters supported the proposed amendment, down from 81 percent in August.

The state Supreme Court voted 6-1 late last week to reject lawsuits filed by Florida’s solar industry and environmental groups to keep the measure off the ballot.
