The New York Police Department has enough evidence for an arrest against Harvey Weinstein, according to the detective leading the investigation.
Detective Nicholas DiGaudio believes there’s enough evidence from “Boardwalk Empire” star Paz de la Huerta to arrest Weinstein on charges of forceful rape in New York City. De la Huerta claims that the former studio head forcibly raped her on two separate occasions, each of which fall under New York State’s statute of limitations for rape in the first degree.
“I believe based on my interviews with Paz that from the N.Y.P.D. standpoint we have enough to make an arrest,” DiGaudio told Vanity Fair.

De la Huerta first met Weinstein when she was 14 years old, but it wasn’t until 12 years later in 2010 that the first alleged incident occurred. The “Walk To Remember” actress was 26 when she met Weinstein at a hotel in New York and he later demanded to go back to her apartment.
“Things got very uncomfortable very fast,” de la Huerta told Vanity Fair. “Immediately when we got inside the house, he started to kiss me and I kind of brushed [him] away.”
“Then he pushed me onto the bed and his pants were down and he lifted up my skirt. I felt afraid . . . it wasn’t consensual . . . it happened very quickly . . . He struck himself inside me . . . When he was done he said he’d be calling me. I kind of just laid on the bed in shock.”
The second alleged incident occurred just a month afterwards when de la Huerta claims she was drunk and Weinstein showed up at her apartment building and found his way into her apartment again. She claims he forcibly raped her then, despite her resistance.
“I was in no state. I was so terrified of him,” de la Huerta told Vanity Fair. “I did say no, and when he was on top of me I said, ‘I don’t want to do this.’ He kept humping me and it was disgusting. He’s like a pig . . . He raped me.”
Dozens of women have come forward with allegations against the disgraced Hollywood executive over the past few weeks, but many of them don’t fall under the statute of limitations. De la Huerta’s attorney has provided material to New York District Attorney Maxine B. Rosenthal proving the actress has spoken about the alleged incidents in the past. Rosenthal is considering bringing charges against Weinstein.
