‘Huge Problem’: Gregg Jarrett Details Legal Hurdles Facing Dems If They Attempt To Replace Biden

Fox News legal analyst Gregg Jarrett detailed Monday on Fox News some of the major legal hurdles Democrats could be facing if they attempt to go through with replacing President Joe Biden as the party’s nominee.

Jarrett appeared on “Hannity” to discuss the reports of some Democrats suggesting that Biden be replaced as the nominee following his poor debate performance last week. Fox guest host Kellyanne Conway began by calling out Biden’s pick of Vice President Kamala Harris, as some are not considering her due to low polling among voters. (RELATED: Majority Of Voters Want To Throw Biden Overboard Following Disastrous Debate, Poll Shows)

“As the Wall Street Journal said today, imagine if Biden had actually picked a competent vice president instead of checking political identity boxes — that would’ve changed the equation dramatically. To your question though, there are two major problems with a replacement candidate. In early voting states there are early ballot deadlines that a replacement would miss. That is a huge problem. They’d have to go to court to get that changed,” Jarrett said.

“But the other problem is a monetary one. Joe Biden is sitting on a 200 million-dollar war chest of donations, but under federal campaign finance laws, he is not allowed to transfer that to replace a new candidate. So you’d be starting from zero, whoever it is. I guarantee you if he drops out, there is going to be chaos and mayhem on the floor of the Democratic National Convention in August in Chicago. It’s going to make the mayhem out on the streets look tame by comparison.”

Following the debate, Democratic pundits immediately began to question a second term for Biden as he had multiple gaffs throughout his debate performance against former President Donald Trump. While some of his surrogates, like California Gov. Gavin Newsom and Maryland Gov. Wes Moore, have continued to stick by his side polls from voters have already begun to doubt the president’s ability to complete another four years.

According to a morning consult poll taken after the debate, 60% of voters — 47% of which were Democrats — say that Biden should be replaced as the nominee. While within the administration have claimed a switch is not in conversation, top names such as Democratic Michigan Gov. Gretchen Whitmer and Newsom have circulated as possible options.
