Technically, the trial is for David Kernell, the college kid who broke into her e-mail account during the 2008 campaign. But she’s been subpoenaed to testify, so of course it’ll be her fault for having her privacy violated:

U.S. District Judge Thomas Phillips denied pre-trial defense motions to have prospective jurors answer a questionnaire asking if they have strong political feelings about Palin. Kernell’s attorney, Wade Davies, cited Palin’s speaking slot at a tea party movement convention and frequent television appearances.
That’s how this is going to go: It’s her fault for being famous, and her fault for using Yahoo to conduct business. Most of all, it’s her fault because they don’t like her.
Try to imagine if somebody had done this to Obama’s e-mail account. Or that of any prominent Democrat, for that matter. Hell, you’re called a seditious terrorist just for disagreeing with them. Breaking into their e-mail? Olbermann and Frank Rich and the rest would be volunteering for the firing squad.
