An attorney for dozens of tea party groups allegedly targeted for improper scrutiny by the IRS angrily rejected the tax agency’s excuse that disgraced official Lois Lerner’s emails were lost after her computer was destroyed, promising to “subpoena every single government agency Lois Lerner talked to.”
Jay Sekulow is the chief counsel for the American Center for Law and Justice, and has represented many conservative groups in their fight against the IRS for the agency’s deliberate targeting of tea party organizations.
Emails from Lois Lerner, head of the IRS Exempt Organizations division during the alleged targeting, reportedly disappeared after her computer crashed and technicians decided to “recycle” her hard drive.
“I think the IRS has destroyed evidence, that’s what I think,” Sekulow claimed in an appearance on Fox News with host Martha McCallum. “Try to pull that off if you’re being audited by the IRS. Just tell them you’d like to have a receipt, but it got lost in your email and your hard drive crashed and it was recycled, and see if they give you their deduction for that expense. I don’t think they will.”
“The American people should be outraged about this,” he asserted. “Congress has been mocked. The president says it’s a phony scandal. And meanwhile, his administration staff and the leaders of his bureau, the IRS, are without a doubt removing evidence.”
Sekulow promised he wouldn’t take the IRS’ excuse lying down. “Here’s what’s going to happen,” he declared. “We’ll subpoena every single government agency that Lois Lerner talked to. That’s the FEC, Federal Election Commission, that’s the Department of the Treasury, that’s gonna be the Department of Justice, and others.”
“She may have lost her emails, but people received those emails,” he noted. “So the people that received them are going to need to turn them over.”
“I’ll tell you what, Martha,” he concluded angrily. “If I was Lois Lerner’s attorney after all this, I’d be telling her to take the Fifth Amendment too. Because what she’s done here, and what she’s allowed people to do, is criminal.”
