Fox News senior judicial analyst Judge Andrew Napolitano said the Supreme Court has opened the door for sanctuary cities to defy the federal government with its recent ruling on the legality of gambling on “Fox & Friends” Tuesday.
The Supreme Court ruled 7–2 in favor of state sovereignty and declared the federal government couldn’t deem state lotteries illegal. Justice Samuel Alito wrote the opinion for the majority. (RELATED: Judge Napolitano Thinks Bob Mueller’s Tactics Amount To Bribery)
“It basically reinforces the notion that the states can resist the federal government when the feds want the states to help enforce federal law,” Napolitano said. “So, if Congress wanted to ban sports betting, it could have made it illegal. And then the federal government would pay to enforce that. Congress tried to shift the cost of enforcing that to the states.”

He said states like California will use the case as an excuse to ignore federal law and continue their sanctuary state policies.
“So, because the states can say we’re not going to cooperate in enforcing federal law, Jerry Brown, the governor of California, can get away with saying too, it’s now a law in California,” Napolitano said, “if you work for the state of California or any subdivision of it, and ICE comes knocking, you don’t have to answer the door.”
